General terms and Conditions Membership Card

1. Participation:

The participation of the Rotalis Membership Card program is subject to a charge and imposed in accordance with the following conditions of participation.

With the requested participation or the first use of the card, you as an applicant agree with these participation conditions. Every person from 18 years is allowed to participate.

The Rotalis Membership Card is not transferable and should be carefully looked after.

In case of a Rotalis trip booking for several persons, the services of the card can only be used by the cardholder. Any other claim of the receipt of the Rotalis Membership Card shall be excluded.

In any case you agree to supply us the dates correctly and completely and if necessary to update them. If the dates of your participation will change, please inform Rotalis Reisen GmbH immediately.

2. Services of the Rotalis Membership Card:

The services of the Rotalis Membership Card can only be used after full payment of the invoice amount. Therefore the mere possession of the card does not authorize the use of services.

With the booking of a Rotalis trip, the ownership must be declared, in order to facilitate the correlation. Upon request of a Rotalis employee, the card has to be presented including a proof of identity. A limitation of liability for Rotalis trips is valid if services or objects do not meet your expectations or wishes or may be faulty.

3. Travel relates services Rotalis Membership Card:                                  

If you do not travel with Rotalis during your membership, Rotalis can just provide non-travel-related services. For travel-related services, there´s no reimbursement or cash payment.

4. Validity

The Rotalis Membership Card is valid to the period of one calendar year (01/01-12/31).

The membership expires automatically. A new membership for a new calendar year has to be requested in writing.

5. Card loss and replacement:

In case that the Rotalis Membership Card gets lost, you as cardholder are obliged to contact Rotalis Reisen immediately under 0043 7712 50 000 or info@rotalis.com. For an administrative fee of 25,- € you will apply for a replacement card. 

6. Termination and change of participation:

You can terminate the agreement of the use of the Membership Card without observing a notice period by a written notice at any time. There is no claim for reimbursement of costs for no-used services. In case of a termination you as cardholder are obliged to make the card unusable or to send it back to Rotalis. Rotalis reserves the right to stop the Rotalis Membership program at any time, to amend or to change it. Furthermore Rotalis preserves the right to amend or to change the participation conditions.

7. Severability clause

Should any provision of these terms of use be or will be ineffective, the validity of the remaining terms is guaranteed. These terms are to be interpreted as the legal and economic purpose of the invalid provision and have to be reached preferably. Furthermore invalid provisions superseded by valid provisions which are close to the intention of invalid provisions, apply. The same applies for a supplementing omission of these terms of use.

8. Advertising/Data protection:

For the participation in the Rotalis Membership Program your full name and complete address is needed. Rotalis is entitled to use the dates for own marketing purposes, to process them and to use it for the sending of information. The rights will be guaranteed according to the correct version of the German Federal Data Protection Act and will be remained completely. On request, Rotalis is happy to inform you about which personal data are saved in our system. We guarantee to treat the processed data confidentially and to protect them from unauthorized access, lost and destruction.

9. Applicable law and place of jurisdiction:

There is exclusively Austrian substantive law without possible law rules to be applied. The application of the UN Sale of Good Convention is expressly excluded. Place of jurisdiction is Ried im Innkreis. For consumers, as laid down in the consumer protection law, the court of the consumer´s residence, the habitual residence or the place of employment, has jurisdiction. (§14KSchG).
